Kanav Bhatheja recently obtained summary judgment for a national retail chain in the United States Court for the Northern District of Illinois.

Plaintiff alleged that he suffered serious neurological injuries after bundles of insulation from a nearby stack fell on Plaintiff. He claimed that the retail store failed to properly secure the insulation and take the necessary precautions. However, the District Court granted summary judgment in favor of the retail store because the stacks of insulation were an open and obvious condition, and no proximate cause on behalf of the retail store could be shown.
