Edmund J. Siegert and Tara C. O'Mahoney Obtain Dismissal of Barbados Product Manufacturer

 

Ed Siegert and Tara O’Mahoney secured a dismissal of a Barbados manufacturer based upon a lack of personal jurisdiction in Illinois. Plaintiff brought suit against a local retailer and the alleged manufacturer of a product that allegedly caused serious burn injuries to her minor son. The product manufacturer was organized under the laws of Barbados and had its principal place of business in that country. The product was manufactured in Honduras, sold to a non-party California company, and shipped into either California or Mexico. The product was not designed for the Illinois market nor sold through any Illinois-based distributor. The Trial Court found that it had neither general nor specific jurisdiction over the foreign manufacturer and dismissed the claim against the foreign manufacturer with prejudice.
