Gary Jansen Prevails on Appeal in Legal Malpractice Case

 

Mr. Jansen obtained an affirmation from the Illinois Appellate Court of the dismissal of a complaint brought against an attorney. The plaintiffs alleged that the defendant attorney breached his fiduciary duty and converted funds related to a closing on a house for a deceased client. Mr. Jansen obtained a dismissal of the complaint based on the plaintiff’s lack of standing because neither plaintiff alleged that he was the executor or representative of the decedent’s estate. The appellate court agreed and affirmed the dismissal. A petition for leave to appeal is presently pending before the Illinois Supreme Court.
