Gary Jansen and Laura Fahey successfully obtained summary judgment in the United States District Court for the Northern District of Illinois, in favor of a home improvement store, based upon natural accumulation doctrine. The plaintiff slipped and fell on liquid while entering the store on a rainy day. Mr. Jansen and Ms. Fahey successfully argued that the liquid was rain water and that the store owed no duty to the plaintiff. They successfully barred the plaintiff’s expert’s affidavit and defeated the plaintiff’s arguments that the store was liable for an uneven floor. Mr. Jansen and Ms. Fahey obtained costs on behalf of the store.
