John Lynch and Neil Pandey Obtain Dismissal of Breach of Contract Action

John Lynch and Neil Pandey successfully defended their client, a national manufacturing company, by securing dismissal of a complaint seeking more than $100,000 in damages. The plaintiff asserted claims for breach of contract and unjust enrichment based on an alleged agreement to perform inspection and sorting services.  John and Neil successfully dismissed the plaintiff’s first two complaints on the basis that the plaintiff had failed to sufficiently allege that a contract existed between the parties. After the plaintiff filed a third pleading, a motion to dismiss for failure to state a claim was filed.  The case was ultimately dismissed with prejudice after counsel for the plaintiff conceded that there was little basis for the claim.
