John Lynch Prevails in Commercial Arbitration Action

 

John Lynch obtained a six figure award in favor of his client in a commercial arbitration case before the American Arbitration Association. The client, a mobile virtual network operator, hired the respondent as a consultant and, later, as its director of corporate development. The respondent was provided with confidential and proprietary information and then used this information in an attempt to overthrow corporate management and seize control of the company. When that failed, he formed a competing business.  The arbitration complaint included claims for breach of fiduciary duty, breach of contract, and tortious interference with a contract. The arbitrator found in favor of the client and awarded compensatory damages, attorneys’ fees and costs.
