Joshua D. Yeager and Tara C. O'Mahoney Secure Dismissal of German Manufacturer in Personal Injury Lawsuit in California State Court

The Superior Court of Riverside County, California dismissed plaintiff’s lawsuit against the firm’s client, a German manufacturer of liftgates. The plaintiff alleged that he was testing a liftgate at work when he suffered injuries to his right knee, right hand, and left foot. The plaintiff asserted negligence and products liability claims against the German manufacturer of the liftgate, as well as a U.S. corporation that sold, installed, and provided service for the liftgate, the seller of the semi-truck on which the liftgate was installed, and the seller of the 20 foot box installed on the semi-truck. Josh and Tara effectively argued that the German corporation lacked the requisite minimum contacts with the State of California, and that there was no evidence to support the exercise of personal jurisdiction over it in the case. The Superior Court of Riverside County, California agreed, finding that the German corporation was not subject to personal jurisdiction. As a result, the German manufacturer was dismissed from the case.
