Joshua D. Yeager and Jennifer M. Lee Secure Dismissal of Chinese Client from Property Damage Lawsuit in Delaware Federal Court

Joshua D. Yeager and Jennifer M. Lee successfully obtained the dismissal of a Chinese client based on lack of personal jurisdiction and on improper service of process in a property damage case in Delaware. The plaintiffs alleged that a residential fire at a condominium building was caused by a drone battery and/or drone battery charger. The plaintiffs asserted breach of express and implied warranty claims against the Chinese manufacturer of the drone battery.   Josh and Jenni effectively argued that the Chinese manufacturer lacked the requisite minimum contacts with the State of Delaware, and that there was simply no evidence to support the exercise of personal jurisdiction over it in the case. Josh and Jenni further effectively argued that the Chinese manufacturer was not properly served through the Hague Service Convention. The United States District Court for the District of Delaware agreed on all points. As a result, the Chinese manufacturer was dismissed with prejudice from the case.
