John P. Lynch Obtains Directed Verdict

In October 2021, John Lynch represented a 501(c)3 entity that provides winterization services to low-income residents of a multicounty area. The plaintiff filed a negligence and breach of contract action alleging that the company coordinated construction work on her home that resulted in flooding and caused related damages that required substantial remediation work.  After trial commenced and the plaintiff’s case was presented, John moved for a directed verdict asserting that his client had no duty to protect the plaintiff from the claimed injury given that there was no contractual relationship between the parties.  He further argued that the plaintiff failed to establish any causal link between the work provided and the claimed damages.  After the benefit of argument, the trial court granted the defendant’s motion.  No appeal was taken.
