John P. Lynch Secures Not Guilty in NLRB Trial for Employer

John’s client, a security company, was accused of retaliatory discharge after having terminated a former employee for engaging in union activity. He and his client contended that the termination was for disclosing sensitive security information. After a trial before the National Labor Relations Board, the judge ruled that the employee had made statements to the media regarding how she provided security at a public location and the equipment she used to provide such security. The court further found that those statements disclosed sensitive security information and, as such, her termination was appropriate. The decision was not appealed.
