Kanav Bhatheja represented a national home improvement retail chain in a lawsuit where the Plaintiff alleged the retail chain failed to properly secure large merchandise from falling on his leg/foot. The Plaintiff alleged that his foot was permanently damaged as a result of the accident. The trial involved testimony from fact witnesses and medical/retail safety experts. After two hours of deliberations, the jury returned a verdict of no liability on behalf of the retail chain.
Plaintiff appealed the verdict to the 7th Circuit Court of Appeals. After extensive briefing on the issue, the 7th Circuit affirmed the jury’s verdict.
